    Acceptable Use Policy

    This Acceptable Use Policy ("AUP") sets out the rules that govern your use of ReplyAgent, operated by Connecta Group Corporation ("ReplyAgent," "we," "us," or "our"). It applies to everyone who accesses or uses our website, application, and services (together, the "Platform"), including your own customers and contacts who interact with messages you send through the Platform.

    This AUP forms part of, and should be read together with, our Terms of Use and Privacy Policy. Capitalized terms not defined here have the meaning given in the Terms of Use. If you use the Platform to send messages over WhatsApp, SMS, voice, or other channels, you are also responsible for complying with the rules of those underlying providers, as described below. If there is any conflict between this AUP and the Terms of Use, the Terms of Use prevail.

    1Purpose and scope

    The Platform provides messaging, customer-relationship, and automation tools across channels such as WhatsApp, Instagram, Messenger, Telegram, SMS, and voice. These channels are powerful, and they are governed by strict rules set by us, by the channel providers (such as Meta), and by applicable law. This AUP explains what you may and may not do so that the Platform stays safe, lawful, and reliable for everyone.

    This policy applies to all users and accounts, including agencies, resellers, and sub-accounts operating under a white-labeled instance of the Platform. If you provide access to others, you are responsible for their compliance with this AUP.

    2Your responsibility

    You are solely responsible for all activity that occurs under your account and for all content and messages you create, send, or store through the Platform. You must:

    • Comply with all applicable laws and regulations, including data protection, consumer protection, anti-spam, and telecommunications laws in every jurisdiction where you and your recipients are located.
    • Maintain the confidentiality of your account credentials and promptly notify us of any unauthorized use.
    • Ensure that anyone you allow to use your account, including your own clients and team members, follows this AUP.
    • Obtain and maintain all rights, permissions, and consents needed for the data and content you process through the Platform.

    3Prohibited uses

    You may not use the Platform to do, or to attempt or enable any third party to do, any of the following:

    • Use the Platform for any unlawful purpose, or in violation of any applicable local, national, or international law or regulation.
    • Send unsolicited or unauthorized advertising, promotional material, "junk mail," "spam," or any other form of duplicative or unsolicited messaging.
    • Impersonate or attempt to impersonate ReplyAgent, a ReplyAgent employee, another user, or any other person or entity, or misrepresent your affiliation with any person or entity.
    • Transmit any material that is defamatory, obscene, harassing, threatening, abusive, hateful, or otherwise objectionable.
    • Upload, transmit, or distribute any worms, viruses, malware, or other code of a destructive or malicious nature.
    • Harvest, scrape, or collect information or data about other users or third parties without their consent, or use automated means to extract data from the Platform.
    • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Platform, or that may harm ReplyAgent or other users.
    • Use the Platform to compete with us, to build a similar or competing product, or to resell access except as expressly permitted in writing.
    • Circumvent, disable, or interfere with security-related features of the Platform or features that restrict use or copying of content.

    4Messaging, consent, and anti-spam rules

    Because the Platform sends messages on your behalf, the following rules are essential. Violating them can cause your account, and potentially other users, to be blocked by channel providers.

    • Prior consent (opt-in). You may only message people who have given you valid, demonstrable consent to be contacted on the relevant channel. You must keep records of how and when that consent was obtained.
    • Honor opt-outs. You must promptly process and honor any request to stop receiving messages, and you must not message anyone who has opted out or asked not to be contacted.
    • No purchased or scraped lists. You may not message contacts obtained from purchased, rented, or scraped lists, or contacts who did not knowingly provide their information to you.
    • Accurate identification. Your messages must clearly identify you as the sender and must not use false or misleading sender information, headers, or subject lines.
    • Respect frequency and timing rules. You must respect applicable limits on message frequency and on permitted contact hours under local law.

    5WhatsApp and Meta platform rules

    ReplyAgent provides messaging through Meta's platforms as a Meta Business Solution Provider. When you use WhatsApp, Instagram, or Messenger through the Platform, you must also comply with Meta's own policies, including the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy, and Meta's Platform Terms, as updated from time to time.

    • You must use approved message templates where required and must not send template messages for purposes other than those for which they were approved.
    • You must not sell, promote, or facilitate goods or services prohibited under the WhatsApp Commerce Policy.
    • You must maintain acceptable quality ratings and must not engage in behavior that generates high block or report rates from recipients.
    • You are responsible for the accuracy of your business profile and display information.
    Why this matters Violations of Meta's policies can result in the suspension of your WhatsApp Business account or phone number by Meta directly. Repeated or severe violations may also affect ReplyAgent's standing as a provider, which is why we enforce these rules strictly.

    6Prohibited content

    You may not use the Platform to create, store, send, or promote content that:

    • Is illegal, or promotes illegal activity, fraud, or deceptive practices.
    • Infringes the intellectual property, privacy, or other rights of any third party.
    • Exploits or harms minors in any way, or depicts child sexual abuse material.
    • Promotes violence, terrorism, self-harm, or discrimination or hatred against individuals or groups.
    • Relates to goods or services that are illegal or restricted in the relevant jurisdiction, including controlled substances, weapons, or unlawful gambling, where prohibited.
    • Contains malware, phishing links, or content designed to deceive recipients into disclosing sensitive information.

    7Acceptable use of AI features

    The Platform includes AI-powered automation and response features. When you use them, you must:

    • Not use AI features to generate unlawful, deceptive, or prohibited content described in this AUP.
    • Not present automated responses in a way intended to deceive recipients about the nature of the interaction where disclosure is required by law.
    • Remain responsible for the output generated through your account and for ensuring it complies with applicable law and the rules of the relevant channel.

    8System and security integrity

    You may not:

    • Attempt to gain unauthorized access to the Platform, other accounts, or any systems or networks connected to the Platform.
    • Probe, scan, or test the vulnerability of the Platform, or breach or circumvent any security or authentication measures.
    • Interfere with or disrupt the Platform, its servers, or networks, including through denial-of-service attacks or by overloading or flooding infrastructure.
    • Use the Platform in a way that imposes an unreasonable or disproportionately large load on our infrastructure.

    9Enforcement and suspension

    We may investigate any suspected violation of this AUP. Where we reasonably believe a violation has occurred, we may, with or without notice, depending on the severity and the requirements of our channel providers:

    • Issue a warning and require you to remedy the violation.
    • Remove or disable access to offending content or messages.
    • Throttle, suspend, or terminate your account or specific features.
    • Report the activity to the relevant channel provider, payment provider, or authorities where required.

    We may act immediately and without prior notice where a violation poses a risk of harm, legal liability, or disruption to the Platform or to our standing with channel providers. As stated in our Terms of Use, we are not liable for action taken in good faith to enforce this AUP.

    10Reporting violations

    If you become aware of any use of the Platform that may violate this AUP, please report it to us at legal@replyagent.com. We take reports seriously and will review them promptly.

    11Changes to this policy

    We may update this Acceptable Use Policy from time to time to reflect changes in our services, in the rules of our channel providers, or in applicable law. When we make changes, we will revise the "Last updated" date at the top of this page. Your continued use of the Platform after a change takes effect constitutes acceptance of the updated policy.
